- Сервіс: Веб-сайт Refcruiter, платформа та всі пов'язані сервіси
- Користувач: Будь-яка фізична або юридична особа, що використовує Сервіс (Кандидати або Роботодавці)
- Кандидат: Шукач роботи, який переглядає вакансії або подає заявки
- Роботодавець: Фізична особа або компанія, яка публікує оголошення про роботу
- Контент: Весь текст, зображення, дані та файли, завантажені або надіслані до Сервісу
- Обліковий запис: Зареєстрований профіль користувача в Сервісі
- Публікація вакансії: Оголошення про вакансію, опубліковане Роботодавцем
// 2. Опис сервісу
Refcruiter - це глобальна платформа дошки вакансій, яка дозволяє:
- Кандидатам шукати вакансії, створювати профілі та подавати заявки
- Роботодавцям публікувати вакансії, переглядати заявки та керувати рекрутингом
- Гостьовим користувачам подавати заявки на вакансії без створення облікового запису
Сервіс надається "як є" і ми залишаємо за собою право змінювати, призупиняти або припиняти функції в будь-який час без попереднього повідомлення.
// 3. Реєстрація облікового запису та право використання
3.1 Право використання
Вам має бути не менше 16 років (18 у деяких юрисдикціях), щоб користуватися Сервісом.
Створюючи обліковий запис, ви заявляєте і гарантуєте, що::
- Ви досягли повноліття для укладення обов'язкового договору
- Вся інформація, яку ви надаєте, є точною та актуальною
- Ви підтримуватимете точність вашої інформації
- Ви маєте повноваження представляти вашу компанію (якщо реєструєтесь як Роботодавець)
3.2 Безпека облікового запису
- Ви несете відповідальність за збереження конфіденційності вашого пароля
- Ви несете відповідальність за всі дії під вашим обліковим записом
- Ви повинні негайно повідомити нас про будь-який несанкціонований доступ
- Ми не несемо відповідальності за втрати через несанкціоноване використання вашого облікового запису
- Ви не можете ділитися обліковими даними з іншими
3.3 Припинення облікового запису
Вами: Ви можете видалити свій обліковий запис у будь-який час через налаштування облікового запису або зв'язавшись з нами. Після видалення:
- Ваш профіль буде деактивовано негайно
- Персональні дані будуть видалені протягом 90 днів (див. Політику конфіденційності) (Політика конфіденційності)
- Активні публікації вакансій будуть видалені
- Невиплачені платежі або повернення коштів будуть оброблені згідно з Розділом 7
Нами: Ми залишаємо за собою право призупинити або припинити ваш обліковий запис, якщо ви:
- Порушуєте ці Умови або наші політики
- Надаєте неправдиву або оманливу інформацію
- Займаєтесь шахрайською або незаконною діяльністю
- Ображаєте або переслідуєте інших користувачів
- Завантажуєте шкідливий контент або віруси
- Намагаєтесь обійти заходи безпеки

// 4. User Responsibilities & Prohibited Conduct
4.1 General Responsibilities
All users must:
- Provide accurate and truthful information
- Comply with all applicable laws and regulations
- Respect intellectual property rights
- Maintain professional conduct
- Not misuse or abuse the Service
4.2 Prohibited Conduct
You may NOT:
- Post false, misleading, or fraudulent job listings
- Post jobs that are not genuine employment opportunities
- Discriminate based on protected characteristics (race, gender, age, etc.)
- Harvest or scrape data from the Service
- Use automated bots or scripts without permission
- Upload viruses, malware, or malicious code
- Impersonate another person or entity
- Spam users with unsolicited communications
- Post content that is illegal, defamatory, obscene, or harassing
- Interfere with the proper functioning of the Service
- Reverse engineer or attempt to access source code
- Use the Service for multi-level marketing or pyramid schemes
4.3 Enforcement
Violations may result in:
- Content removal
- Account suspension or termination
- Legal action and reporting to authorities
- Liability for damages incurred by us or other users
// 5. Candidate Responsibilities
5.1 Application Submissions
When submitting job applications, you must:
- Provide accurate and honest information in your resume/CV
- Ensure you have the right to work in the job location
- Not submit false credentials or qualifications
- Respect employer application instructions
5.2 Resume/CV Content
- You are responsible for the content of your uploaded resume/CV
- Do not include sensitive personal data (national ID, passport numbers, etc.) unless required
- Ensure you have the right to share any included references or portfolio work
- ⚠️ Resumes will be stored for 90 days and then automatically deleted
5.3 Communication with Employers
- Respond professionally to employer communications
- Do not solicit employers for non-job-related purposes
- Report suspicious or fraudulent job postings to

// 6. Employer Responsibilities
6.1 Job Posting Requirements
All job postings must:
- Describe genuine employment opportunities
- Contain accurate job requirements and descriptions
- Not discriminate based on protected characteristics
- Comply with employment laws in the job location
- Not be used to collect candidate data for non-recruitment purposes
- Not contain misleading salary information
6.2 Prohibited Job Postings
You may NOT post jobs that:
- Are commission-only positions without clear disclosure
- Require upfront payments or fees from candidates
- Are multi-level marketing or pyramid schemes
- Involve illegal activities
- Contain external links for data harvesting
- Are duplicates of existing active postings
6.3 Anti-Discrimination & Equal Opportunity
Employers must comply with equal employment opportunity laws:
- Do not discriminate based on: race, color, religion, sex, national origin, age, disability, genetic information, sexual orientation, gender identity, or other protected characteristics
- Job requirements must be bona fide occupational qualifications
- Salary ranges should be provided where required by law (e.g., Colorado, California)
⚠️ Violations will result in immediate removal of job postings and account termination.
6.4 Data Controller Responsibilities
When you receive candidate applications, you become an independent Data Controller:
- You must comply with GDPR, CCPA, and other applicable privacy laws
- Process candidate data only for recruitment purposes
- Implement appropriate security measures
- Respect candidate data rights (access, deletion, etc.)
- Delete candidate data when no longer needed
- See our Privacy Policy for details
6.5 Application Review & Communication
- Review applications in a timely manner
- Communicate professionally with candidates
- Do not contact candidates for purposes outside the job application
- ⚠️ Download application materials within 90 days (automatic deletion after 90 days)
// 7. Pricing, Payments & Refunds
7.1 Free Services
Candidates can use the Service for free, including:
- Browsing job listings
- Creating a profile
- Submitting unlimited applications
7.2 Paid Services (Employers)
Employers must purchase a job posting package to post jobs:
- Pricing is displayed on the pricing page and during checkout
- Prices are in USD, EUR, PLN, or other currencies as displayed
- Packages include a specific number of job posting slots
- Job postings are active for the duration specified in the package (e.g., 30 days)
7.3 Payment Processing
- All payments are processed securely via Stripe
- We do not store credit card information
- You authorize us to charge your payment method for all fees incurred
- Receipts and invoices are sent via email
7.4 Taxes
- Prices may not include applicable taxes (VAT, sales tax, etc.)
- You are responsible for any taxes imposed on your purchase
- EU businesses: Provide a valid VAT ID to avoid VAT charges (if applicable)
7.5 Refund Policy
- Refunds are issued at our sole discretion
- Unused job posting slots may be refunded if requested within 14 days of purchase
- Active or expired job postings are non-refundable

// 8. Intellectual Property Rights
8.1 Our Intellectual Property
The Service and its original content, features, and functionality are owned by Refcruiter:
- Source code, design, layout, and graphics are protected by copyright
- "Refcruiter" name and logo are our trademarks
- You may not copy, modify, distribute, or reverse engineer our intellectual property
- You may not use our trademarks without written permission
8.2 Your Content
You retain ownership of content you upload (resumes, job descriptions, etc.):
- By uploading content, you grant us a limited license to:
- Store, display, and transmit your content to provide the Service
- Make backups and derivative copies for technical purposes
- This license is non-exclusive, royalty-free, worldwide, and ends when you delete content
- You represent that you have all rights necessary to upload your content
8.3 DMCA & Copyright Complaints

- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of content
9.2 No Guarantee of Results
- We do not guarantee that candidates will receive job offers
- We do not guarantee that employers will receive qualified applications
- We do not verify credentials, qualifications, or background of users
- We are not responsible for the actions of employers or candidates
9.3 Third-Party Services
- We integrate third-party services (Stripe, Supabase, OAuth providers)
- We are not responsible for third-party service failures or data breaches
- Third-party terms and privacy policies apply to their services
// 10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
10.1 No Liability for Indirect Damages
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
- Loss of profits, revenue, or business opportunities
- Loss of data or content
- Loss of employment opportunities
- Costs of substitute services
- Emotional distress or reputational harm
10.2 Cap on Liability
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED:
- For candidates: €100 EUR
- For employers: The amount you paid us in the 12 months preceding the claim
- For all others: €100 EUR
// 11. Indemnification
You agree to indemnify, defend, and hold harmless Refcruiter, its founders, employees, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of third-party rights (intellectual property, privacy, etc.)
- Content you upload or submit
- Your use of the Service
- Disputes between you and other users
// 12. Governing Law & Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of Poland, without regard to conflict of law principles.
For users in specific jurisdictions:
- EU Users: You retain rights under mandatory EU consumer protection laws
- California Users: California consumer protection laws may apply
- Other Jurisdictions: Local consumer protection laws may provide additional rights
12.2 Jurisdiction & Venue
- Disputes shall be resolved in the courts of Poland
- You consent to personal jurisdiction in Polish courts
- For EU consumers: You may bring claims in your country of residence
12.3 Informal Dispute Resolution (Required First Step)
Before filing a lawsuit, you must:
